Chemical surveys for Public and Private businesses are on file at
the Health Department

•Employees
may confidentially contact the Health Department for information
contained in these surveys.

•Random
site inspections are done to assure workers are trained in the safe
use of these materials and that files are in order.
The New Jersey Worker and Community Right to Know Act requires public and
private employers to provide information about hazardous substances at their
workplaces.
The Act:
- Informs public employees about chemical hazards at their
workplace so they can work safely with these hazardous substances
- Helps firefighters, police, and other emergency responders plan
and respond to incidents such as fires, spills, and explosions.
- Provides data for monitoring and tracking hazardous substances
in the workplace and in the environment
All employers covered by the Act must complete surveys listing
the names and quantities of hazardous chemicals stored and used at their
facilities.
- The NJ Department of Health and Senior Services (NJDHSS) enforces
all provisions of the RTK Act in public workplaces and RTK labeling in
private workplaces. The department prepares Hazardous Substance Fact
Sheets, the RTK brochure, and other materials to increase awareness of
hazardous chemicals and help public employers comply with RTK law.

- The NJ Department of Environmental Protection (NJDEP) enforces the
community provisions of RTK Act in private sector (except for labeling).
NJDEP is also responsible for implementing Title III (Emergency Planning
and Community Right to Know) of Federal Superfund Amendments and
Reauthorizations Act (SARA), which establishes requirements for industry
regarding emergency planning and reporting of hazardous chemicals.
